DRAFT — pending legal counsel review. This is a working draft prepared by the CelebIsland team. It has not been reviewed by qualified legal counsel, is not final, and may change. Items marked [COUNSEL TO CONFIRM] are open questions for counsel.

1. What the Marketplace is

The CelebIsland Market and Merch Store let users and businesses list and sell physical goods, digital goods and services to other users. CelebIsland provides the platform; unless an item is clearly sold by CelebIsland itself, the contract of sale is between the buyer and the seller.

2. Seller obligations

  • Describe items accurately, with real photos, condition, price, delivery costs and delivery time.
  • Hold any licence, permit or registration your goods or business require.
  • Display your own return and refund terms. Where you do not, the default rules in the Refund Policy apply.
  • Ship what you sold within the stated time, and keep proof of dispatch and delivery.
  • Comply with consumer-protection law. [COUNSEL TO CONFIRM: applicable obligations under the Federal Competition and Consumer Protection Act 2018.]

3. Prohibited items

You may not list: illegal drugs and drug paraphernalia; weapons, ammunition and explosives; counterfeit or replica branded goods; stolen goods; human remains or body parts; live animals protected by law; prescription medicines without authorisation; adult sexual services; hacking tools or stolen data, accounts or credentials; fake documents or certificates; gambling services; anything else illegal where the buyer or seller is located.

4. Buyer obligations

  • Pay the listed price through the payment methods the platform offers.
  • Inspect items on delivery and raise any problem promptly through the order's dispute option.
  • Do not abuse disputes or leave fraudulent reviews.

5. Payments and fees

Payments are handled under the Payments Terms. CelebIsland may charge sellers a listing or transaction fee. [COUNSEL TO CONFIRM: fee schedule.]

6. Disputes

If something goes wrong, the buyer opens a dispute in the order within the window stated in the Refund Policy. Both sides can submit evidence. CelebIsland reviews and decides how funds held for the order are released. This does not limit any statutory rights either party has.

7. Reviews and ratings

Reviews must reflect a genuine transaction and honest experience. We remove fake, paid-for or retaliatory reviews.

8. Enforcement

We may remove listings, hold funds, restrict selling, or ban accounts that break these terms or the Community Standards, and we may report illegal activity to authorities.

9. Liability

To the extent permitted by law, CelebIsland is not the seller of third-party items and is not responsible for their quality, safety or legality. [COUNSEL TO CONFIRM: enforceable limitation-of-liability wording.]
