DRAFT — pending legal counsel review. This is a working draft prepared by the CelebIsland team. It has not been reviewed by qualified legal counsel, is not final, and may change. Items marked [COUNSEL TO CONFIRM] are open questions for counsel.
1. Our approach
CelebIsland respects the rights of creators. Only post content you created yourself or have permission to use. This policy explains how rights holders can report infringement and how users can respond. [COUNSEL TO CONFIRM: alignment with the Nigerian Copyright Act 2022 notice-and-takedown provisions, and with the US DMCA for US-based rights holders.]
2. Reporting infringement (takedown notice)
A rights holder or their authorised agent can send a notice to copyright@celebisland.com [COUNSEL TO CONFIRM: designated agent and address] or through Contact us. The notice must include:
- Your name, address, phone number and email address.
- Identification of the copyrighted work you claim is infringed.
- The exact link(s) to the content on CelebIsland you want removed.
- A statement that you believe in good faith the use is not authorised by the owner, its agent or the law.
- A statement that the information in the notice is accurate and that you are the owner or authorised to act for the owner.
- Your physical or electronic signature.
3. What happens next
We review the notice, remove or disable access to the content where it is valid, and tell the user who posted it, including a copy of the notice (with the reporter's contact details where the law permits or requires).
4. Counter-notice
If you believe your content was removed by mistake or you have the right to use it, you can send a counter-notice with: your contact details; the content removed and where it appeared; a statement under penalty of perjury that you believe it was removed by mistake or misidentification; consent to the jurisdiction of the appropriate court; and your signature. We may restore the content unless the rights holder tells us they have started legal action. [COUNSEL TO CONFIRM: waiting period.]
5. Repeat infringers
Accounts that receive repeated valid copyright notices will have content removed, features restricted, and may be permanently terminated.
6. Music, live streams and Airwave
Background music, DJ sets and broadcasts of third-party content in live streams, Airwave rooms, watch parties and recordings must be licensed. Rooms that broadcast unlicensed content may be stopped while live.
7. Abuse of the process
Submitting a false or abusive notice or counter-notice may lead to account action and may expose the sender to legal liability.
8. Trademarks
Trademark complaints (for example counterfeit goods or impersonating a brand) can be sent through Contact us and are handled under the Community Standards and Marketplace Terms.
